Although these Terms & Conditions do not reproduce in full the provisions of EU Directive 2011/83/EU on Consumer Rights (implemented in Spain via Ley 3/2014), we are committed to full compliance with its requirements.
Summary of Our Agreement
When you place an order with us, the following applies:
- We will send you a confirmation email once your order has been placed.
- Payment will be charged at the time of purchase.
- A contract between us is formed when the ordered goods are dispatched.
- All handmade and custom-made products are non-refundable and non-exchangeable, except in cases of defect or misrepresentation. Please refer to Section 5 for full details.
- All other contractual terms are set out below

1. Introduction
1.1 These Terms & Conditions govern your use of our website aquantanova.com.
1.2 By using our website, you fully accept these Terms & Conditions. If you do not agree with any part of these terms, please do not use our website.
2. Order Process
2.1 By placing an order through our website, you confirm that you are legally entitled to enter into binding contracts and are at least 18 years of age.
2.2 Upon placing an order, you will receive an email acknowledging receipt. Please note that this acknowledgement does not constitute acceptance or confirmation of your order.
2.3 If, during processing, we are unable to fulfil your order for any unforeseen reason, we will cancel it and notify you by email, explaining the reason (e.g. stock unavailability, payment failure, or a pricing or product description error).
2.4 Your order is accepted and a contract is formed at the moment the ordered goods are dispatched.
3. Prices and Payment
3.1 The price of any product will be as displayed on our website at the time of ordering, except in cases of obvious error.
3.2 Prices include Spanish IVA (VAT) where applicable at the current rate, but exclude delivery costs, which will be added to the total at checkout.
3.3 Payment may be made using the methods listed on aquantanova.com.
3.4 Payment is charged at the time of purchase.
4. Delivery
4.1 We will deliver goods to the delivery address provided in your order.
4.2 Delivery will be made as soon as reasonably possible following acceptance of your order and, in any case, within 40 days of the order date.
4.3 Orders shipped outside the European Union may be subject to import duties, taxes, and/or customs charges. The buyer is solely responsible for compliance with all customs requirements of the destination country, including the payment of any applicable duties, taxes, or charges. Should an order be delayed or returned due to non-compliance with such requirements, we cannot be held liable, and the order will be considered fulfilled.
5. Returns and Refunds
5.1 Please note: The vast majority of products available on aquantanova.com fall into non-refundable categories. Specifically, the following products are strictly non-refundable and non-exchangeable under any circumstances, except in cases of proven manufacturing defect:
- Audio programmes and digital files (AquaInitiator format programmes) — as downloadable or digitally delivered products, they cannot be returned once accessed or delivered
- Handmade and custom-made devices (AquaCorrectors, SpinPolarisers, AquaPolarisers, Health Cylinders, and similar) — as products made individually by hand to order, they are non-refundable by their nature
- Personalised products — items produced to individual specifications (including Individual-Action AquaInitiators created from personal photographs)
- Discounted items
- Gift cards
By placing an order on aquantanova.com, the customer confirms their understanding and acceptance of these conditions.
5.2 In accordance with EU Consumer Rights Directive 2011/83/EU, consumers have the right to withdraw from a distance contract within 14 calendar days of receiving the goods, without providing a reason, provided the product is in its original condition and original packaging, undamaged and unused. This right does not apply to the product categories listed in Section 5.1.
5.3 To exercise your right of withdrawal, you must notify us in writing (by email to [email protected]) within 14 calendar days of receiving your order.
5.4 After 14 calendar days from the date of receipt, we are unable to offer a full refund or exchange.
5.5 Only items purchased at full price are eligible for return. Discounted items are non-refundable.
5.6 To return a defective item, you must notify us by email, attaching photographic and/or video evidence of the defect, and return the product within 14 calendar days of receipt, at your own cost and risk, in its original packaging and in suitable condition.
5.7 For higher-value returns, we recommend using a tracked delivery service or purchasing shipping insurance. We cannot guarantee receipt of returned items.
5.8 Refunds will be processed as soon as possible and, in any case, within 14 days of receiving the returned product (in accordance with EU regulations). If you fail to return the goods or cover the cost of return shipping, we reserve the right to deduct those direct costs from the refund amount.
6. Cancellation by Us
6.1 We reserve the right to cancel an order if:
- Insufficient stock is available to fulfil the order
- Payment cannot be processed
- An error is identified in the product description, pricing, or offer
- We do not deliver to your region
6.2 Should we cancel your order, we will notify you by email and issue a full refund to your original payment method within 14 days of the order date.
6.3 We reserve the right to remove any product from this website and/or edit or remove any materials or content at any time. We may decline to process a transaction or refuse service to any individual at our sole discretion, without liability to you or any third party.
7. Intellectual Property
7.1 All copyright in the text, graphics, layouts, software, and compilations of this website belongs to BIOAQUA SYSTEMS — Tarasenko Sviatoslav, or is used under licence.
7.2 You may not, without our prior written consent, copy, transmit, reproduce, publish, display, distribute, store, modify, or adapt this website, its content, or its software, except for personal non-commercial use.
8. Data Use and Storage
Please refer to our Privacy Policy for full information on how we collect, store, and use your personal data, in accordance with the EU General Data Protection Regulation (GDPR).
9. Limitation of Liability
9.1 Our liability for any losses you suffer as a result of a breach of this agreement is strictly limited to the purchase price of the product in question.
10. Online Dispute Resolution

10.2 We are not obliged to participate in alternative dispute resolution proceedings but will make every effort to resolve any complaint directly and amicably.
11.Governing Law
11.1 These Terms & Conditions are governed by and construed in accordance with the laws of Spain.
11.2 Any disputes arising in connection with these Terms & Conditions shall be subject to the jurisdiction of the courts of Barcelona, Spain, without prejudice to the mandatory consumer protection rights applicable in the consumer’s country of residence within the EU.
